Terms of Service

1. Who we are

Pixedi is a software-as-a-service product operated by Pixedi Digital Agency, a Turkish entity (the “Operator,” “Pixedi,” “we,” “us”). The Pixedi Aristo widget is embedded on the websites of our business customers (each, a “Customer”) to capture leads, hold short conversations with end-visitors, and route inquiries to next steps.

These Terms govern the relationship between Pixedi and the Customer. End-visitors of a Customer’s site interact with our software at the Customer’s direction; the Customer is responsible for ensuring its own privacy notices and end-visitor consents reflect that.

2. Account and eligibility

Pixedi is sold for commercial and professional use only. By creating an account you represent that you are at least 18 years old and authorized to enter into this agreement on behalf of the legal entity you identify at signup.

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at support@pixedi.com if you suspect unauthorized access.

3. Subscription, fees, and billing

All plans are billed in U.S. Dollars (USD). A valid payment method is required at signup; we do not offer free trials. Stripe processes payments on our behalf; we never see or store your full card number.

Monthly subscriptions auto-renew at the end of each month. You may cancel at any time from the Customer Portal; cancellation takes effect at the end of the then-current period and you keep access until then.

Annual subscriptions are a 12-month commitment. They cannot be canceled mid-term. To prevent the next annual term from auto-renewing, you must email support@pixedi.com at least 30 days before the renewal date. Within that 30-day window, the next term has already been scheduled.

Stripe Tax is enabled on our checkout and computes any applicable sales tax, VAT, or other transaction tax based on your billing address. The amount shown at checkout is the amount you pay.

4. Acceptable use

You will not use Pixedi to harass, defraud, or deceive end-visitors, to impersonate another business, to collect data you are not authorized to collect, to reverse-engineer or scrape our service, or to violate any law applicable to your business or to the end-visitors you serve.

We reserve the right to suspend or terminate access — with reasonable notice where possible, immediately where the conduct creates imminent harm or legal risk — for material breach of this section.

5. Service availability

We work to keep Pixedi available continuously, but we do not commit to a specific uptime percentage in this version. Maintenance windows, third-party outages (OpenAI, Stripe, Supabase, Vercel, Cloudflare), and good-faith error correction are normal parts of operating the service.

If a sustained outage materially prevents you from using the service, contact support@pixedi.com. Service-credit policies, when published, will be the exclusive remedy for unavailability.

6. Refund policy

Subscription fees are non-refundable except where required by applicable law. We do not refund unused portions of a billing period when a subscription is canceled, and we do not refund annual subscriptions mid-term.

We do not refund charges that you allege are the result of a third party’s unauthorized use of your account, where the unauthorized use was not made possible by Pixedi’s own act or omission. Secure your account; we are not your insurer.

If we reverse a charge in our discretion, the amount and timing will be at our determination and will not constitute a precedent for further reversals.

7. Customer data and intellectual property

Customer Data means content you submit to Pixedi and content end-visitors submit through your widget — for example, conversations, captured leads, names, email addresses, and metadata associated with these exchanges. As between you and Pixedi, the Customer owns the Customer Data; you grant Pixedi a worldwide, non-exclusive license to host, process, and display the Customer Data solely to operate, maintain, and improve the service for you.

Pixedi retains all rights in the service software, the underlying widget, the dashboard, the AI prompt configuration, and any aggregated, de-identified analytics derived from operating the platform.

8. Privacy

Our Privacy Policy at /legal/privacy describes what information we and our sub-processors collect, how it flows, and how long it is retained. By using Pixedi you consent to the practices described there.

If you operate Pixedi for end-visitors located in jurisdictions with stricter rules (for example the EEA, UK, California), it is your responsibility to surface a consistent privacy notice on your own site and obtain end-visitor consent where required.

9. Disclaimer of warranties

Pixedi is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated responses will be accurate or appropriate for any specific use case.

10. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability under this agreement, for any claim or series of related claims, will not exceed the total amount you paid Pixedi in the twelve months preceding the event giving rise to the claim.

11. Indemnification

You will defend and indemnify Pixedi against third-party claims arising from your Customer Data, your use of the service in violation of these Terms, or your end-visitors’ interactions with your widget where you failed to provide a required notice or consent.

12. Changes to the service or these Terms

We may modify the service over time. We will give you reasonable notice — typically by email and a banner in the dashboard — for changes that materially reduce a feature you actively use.

We may modify these Terms with at least 30 days’ notice for non-trivial changes. If you do not accept the change, your remedy is to cancel your subscription before the new Terms take effect; continued use after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without reference to conflict-of-laws principles. The courts of Istanbul Çağlayan (İstanbul Çağlayan Mahkemeleri) have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.

Nothing in these Terms limits any non-waivable consumer right that applies to you. If a court holds any part of these Terms unenforceable, the rest stays in effect.
